Acceptance of Terms
By accessing or using the Pressfit.ai website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our website or services. These terms apply to all visitors, users, and clients of Pressfit.ai.
Services Description
Pressfit provides B2B messaging and pipeline generation services using behavioral intelligence. Our services include ICP (Ideal Customer Profile) messaging development, message testing and optimization, and outbound deployment across email and LinkedIn. Specific deliverables, timelines, and scope are defined in individual Statements of Work (SOWs) agreed upon before each engagement begins.
Engagement Terms
All service engagements are governed by individual Statements of Work that specify deliverables, timelines, pricing, and scope. Pricing for each engagement is defined in the applicable SOW. No work begins until both parties have agreed to the SOW terms. Changes to scope or deliverables require written agreement from both parties.
Intellectual Property
Upon full payment, you own all deliverables produced during your engagement, including ICP profiles, messaging angles, deployment templates, and testing data. Pressfit retains the right to use anonymized, aggregate insights from engagements to improve our methodology. Pressfit retains ownership of its proprietary tools, processes, and behavioral intelligence methodology.
Client Responsibilities
You agree to provide accurate and timely information necessary for us to deliver services, including target market information, current messaging assets, and access to outbound performance data as applicable. You are responsible for ensuring that the use of deliverables complies with all applicable laws, including CAN-SPAM, GDPR, and any industry-specific regulations governing your outbound communications.
Payment Terms
Payment terms are specified in each Statement of Work. Unless otherwise agreed, invoices are due within 30 days of issuance. Late payments may incur a fee of 1.5% per month on the outstanding balance. Pressfit reserves the right to pause work on any engagement with overdue payments until the balance is resolved.
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during an engagement. This includes business strategies, customer data, messaging performance data, and any materials marked as confidential. Confidentiality obligations survive the termination of any engagement for a period of two years.
Limitation of Liability
Pressfit provides services on a best-efforts basis. While we use data-driven methodology to optimize messaging, we do not guarantee specific revenue outcomes, meeting volumes, or conversion rates. In no event shall Pressfit be liable for indirect, incidental, consequential, or punitive damages arising from the use of our services. Our total liability for any claim related to an engagement shall not exceed the fees paid for that specific engagement.
Termination
Either party may terminate an engagement with 30 days written notice. Upon termination, you will receive all completed deliverables and work-in-progress produced up to the termination date. Fees for work completed prior to termination are non-refundable. Pressfit reserves the right to terminate services immediately if payment obligations are not met or if these terms are materially breached.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these terms or related services shall be resolved through binding arbitration in Delaware, unless both parties agree to an alternative resolution method.
Changes to Terms
We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of Pressfit.ai after changes are posted constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.
